The Contractor
The contractor agrees to perform work in a competent manner
according to British Standard 3998:1989 and all current research
or directives, in compliance to the specification and quotations
contained in the estimate.
All Quotations
All quotations and instructions are accepted on the basis
of payment of full invoice price within 7 days of the date
of invoice.
Amendments
Amendments to the quotations must be made in writing.
The contractor shall employ only careful, skilled staff who
are experienced in such works and at no time must the contractor
use climbing irons when climbing live trees.
All trees appearing on the schedule of work have been inspected
from ground level and recommendations have been made on this
basis. If while we carry out this schedule the contractor
discovers a defect not previously detected and in his opinion,
a threat to public safety he will report this defect to the
client who can then agree on any variations to the quotations.
Private covenants
Investigation of private covenants shall be the responsibility
of the owner and no liability shall attach to the contractor
for a breach of any such covenant.
Underground services
Unless a plan showing the exact location of underground pipes,
wires or cables has been forwarded to us by the owner of the
land for his agent prior to the formation of the contract,
the contractor shall be under no liability for any damage
caused as a result of work performed under the contract to
such pipes, wires or cables, or for any damage to property
resulting therefore and the owner of the land or his agent
shall be solely liable for any such damage.
Power lines or telephone cables
Any charges for the removal of power lines or telephone cables
are to be the responsibility of the agent or owner of the
property.
Stump grinding
Stump grinding involves the removal of the tree stump, but
does not include the removal of lateral root or stump chippings
unless specified.
Site conditions
The contract price is based on the site conditions, existing
at the time of preparation of the estimate, remaining unchanged.
Value Added Tax
Where applicable, Value Added Tax (V.A.T.) will be charged
at the current rate.
Complaints
Any complaints which arise from work performed under any contract
arising from acceptance of the estimate must be made within
the period of 7 days from the date of invoice, unless agreed
in writing to the contrary.
Tree preservation orders and conservation
areas
The trees concerned in the contract may be in a conservation
area or be subject to a tree preservation order. Upon receipt
of the owners written acceptance of the contract, JJ&B
Treecare will obtain the necessary permission to carry out
the work from the relevant authority.
Completion of the contract
The contractor will not be liable in damages or otherwise
because of non-performance of a contract arising on account
of adverse weather conditions, strikes, lock-outs, war and
civil commotion, or lack of adequately skilled labour due
to causes beyond our control. Further, we retain the right
in such circumstances to cancel the contract in whole or in
part. Completion dates shall be contingent upon weather conditions.
Expiry of the quotation
Three months after the submission of the quotation, the contractor
reserves the right to withdraw and re-price work, unless otherwise
agreed in writing on acceptance of instructions from the owner.
Hidden obstructions
Quotations for felling are based on the assumption of trees
being free from metal, stone or other hidden obstructions.
In the event of a tree being impossible to fell in the normal
way, the company reserves the right to re-quote accordingly.
Insurance cover
All works carried out by the contractor is covered by full
third party and public liability insurance for damage to persons
or property that may result in the implementation of the contract.
